Особенности предмета доказывания по трудовым спорам
в судах общей юрисдикции

Аннотация. В статье проведен комплексный анализ ключевых особенностей рассмотрения и решения индивидуальных трудовых споров судами общей юрисдикции. Авторами определено место судебной защиты в системе способов защиты нарушенных трудовых прав, а также выделены особенности процессуальных процедур. В исследовании подробно проанализированы проблемы распределения бремени доказывания с учетом необходимости защиты работника как более слабой стороны в трудовом споре в целях уравнивания возможностей обычного сотрудника и работодателя в судебном процессе. Особое внимание уделено проблеме трансформации трудовых отношений в условиях цифровизации, которая обусловливает необходимость пересмотра существующих сегодня подходов к оценке цифровых доказательств. На основе анализа судебной и правоприменительной практики предложена авторская классификация трудовых споров. По итогам исследования сформулированы предложения, направленные на совершенствование действующего гражданско-процессуального и трудового законодательства в целях повышения эффективности рассмотрения трудовых споров судами общей юрисдикции.

Abstract. This article provides a comprehensive analysis of the key aspects of the consideration and resolution of individual labour disputes by courts of general jurisdiction. The place of judicial protection within the system of the methods for protecting the violated labour rights and highlight the specifics of procedural procedures is defined by the authors. The study thoroughly analyzes the problem of the distribution of the burden of proof taking into account the need to protect an employee as a weaker party in a labour dispute, with the goal of equalizing the opportunities for both the employee and the employer in legal proceedings. The work focuses specifically on the transformation of labour relations in the context of digitalization, which necessitates the current approaches revision to the evaluation of digital evidence. Driven by an analysis of judicial and law enforcement practice, the authors offer a classification of labour disputes. Based on the results of the research, proposals to improve the current civil procedure and labour legislation with the aim to enhance the effectiveness of labour dispute resolution by the courts of general jurisdiction have been formulated.
